Will of Zachariah Shrapnell 17th May1723
In the Name of God Amen I Zachariah Shrapnell of Bradford in the County of Wilts, Clothier being sick & Weak in Body, but of a sound and disposing Mind, Memory and understanding do make and ordain this my last Will and Testament in manner and form following imprimus I give devise and bequeath unto my loving Nephew Zachariah Shrapnell, Eldest son of my Brother Noah Shrapnell All those my Messuages, Lands and Tenements and heridiaments with the Appurtenant situate, lying and, being in the several parishes of Bradford aforesaid Wingfield, Trowbridge and elsewhere in. the said County of Wiltshire. To hold to my said Nephew Zachariah Shrapnell his heirs and assigns forever subject and chargeable never the Less in such manner as the same is herein after subject and charged Hence I give and bequeath unto my said brother Noah Shrapnell and Grace his Wife £300 of lawful Money of (Great Britain to be paid them within twelve months after my decease upon condition shall within one year after my decease by goods and sufficient deed or deeds in the law as the Counsel in the Law of my said Nephew Zachariah Shrapnell shall advise; grant, convey and assure unto my said nephew messuages, Lands Tenements, Rents and Heridiaments with the appurts in the Parish or Bradford aforesaid and the Reversion and Reversions, Remainder and Remainders there of which were by Deeds in the Lifetime of my said dear father deceased settled by him in Trust for me and which upon my Death without issue will by the said last mentioned Deeds pass unto my said Brother by Survivorship and also do and shall in like manner within one year after my decease by goods and sufficient deed or deeds or other Art or Arts in law as the Counsel of my said Nephew Zachariah Shrapnell shall advise grant convey and assure unto my said Nephew all that Messuage, Closes, Lands and Heridiaments situate at Leigh in the Parish of Bradford aforesaid with my said Dear Father gave to my said Brother Noah, his heirs and assigns to hold the said last mentioned Messuages, Closes, Lands and Herediaments with its Appurtenants situate and being at Leigh aforesaid from and immediately after the decease of him my said Brother Noah. Unto my said Nephew Zachariah Shrapnell, his heirs, and assigns for ever And in case my said Brother Noah and his said Wife shall refuse to execute such goods and sufficient Deed or Deeds in the Law to my said Nephew Zachariah Shrapnell That then the gift and bequest to them of the said £300 as aforesaid to be void and in such case give and bequeath this same to my said Nephew Zachariah Shrapnell, his Executors, Admms. and Assigns, Item I give and bequeath unto the four children of said brother Noah Shrapnell (to wit) unto my Nephew John Shrapnell £400 to be paid him (with interest after his attainment of his age of 22 years) when he shall attain his age of 24 years and not before. Item I give and bequeath unto my niece Ann Shrapnell £400 Upon condition she marries by and with the consent and approbation of my said Brother Noah Shrapnell and John Bailward of Bradford, Gent. or the survivor of them to be paid her within 2 years after my decease And my will further is that in Case my said Niece Ann Shrapnell shall not marry by and with such consent and approbations aforesaid That then and in such case the Gift and bequest to her of the said £400 to be void And it then give and bequeath the same to my said Nephew Zachariah Shrapnell . Item I give and bequeath unto my Nephew Henry Shrapnell £100 to be paid him within 2 years after my decease. Item I give and bequeath unto my niece Grace Rodbard, wife of Aron Rodbard of Taunton in the County of Somerset, Fuller one annuity or yearly payment of £5 of Lawfull money of Great Britain during her natural Life clear of all conditions to be paid unto her own separate hands and where with her said husband shall not have to do or intermediate by equal quarterly payments by and out of the Rents and profits of my Estate in Bradford aforesaid. I also give and bequeath unto my said Niece Grace Rodbard £100 to be paid within 12 months after my decease and with the payment which said legacies aforesaid I do here by Charge an my Messuages, lands, Tenements and Heridaiments whatsoever so devised to my said Nephew Zachariah Shrapnell as aforesaid. And my will and Desire further is that if any or either of my said Nephews or Nieces John Shrapnell, Henry Shrapnell, Ann Shrapnel! and Grace Rodbard shall happen to die before he, she or they respectively become entitled to his her or their legacy or legacies given by this my will That then and in such case the legacy or legacies of him, her or they... Item I give and bequeath unto my dear Sister Elizabeth Deane one annuity or yearly payment of £15 of lawful money of Great Britain during her natural1ife clear of an Deductions whatsoever upon condition that she do within 12 months after my decease release unto my said brother Noah Shrapnell and to his heirs, Executors and Admins. all such right, Title and interest that she hath or may have of in or to one annuity or yearly payment of £5 payable to her during her life tune by my said Brother Noah Shrapnell by virtue of the last Will and Testament of my dear father deceased or by some other ways and means by and out of .. part of the Lands aforesaid to be paid her by equal Quarterly Payments by and out of the rents, Issues and Profits of my Messuages, Lands and Tenements in Bradford, aforesaid and with the payment there of.. hereby Charge my Messuages, lands... Item whereas over and above what I have already given to my Niece Elizabeth Davis another of the said Daughters of the said Noah Shrapnell on her Marriage with Henry Davis of Frampton Cotterell in the County of Gloucester, Gentleman Ihave promised to give £100 to such child or children to be born of their two bodies as should live to attain the age of 21 as they my said Nephew and Niece Henry Davis and Elizabeth his Wife or one of them should direct and appoint - Now in pursuant of such promise and of my said Nephew Henry Davis do and shall execute a Bond to my Executor herein after named in a sufficient penalty afforded to his agreement with me forn that purpose with condition to repay to my executor or Assigns. £100 of the fortune .
….Item I give to my said dear brother Noah and Henry Davis and Elizabeth his wife a suit of Mourning to each and every of them. Item I give unto my cousin Samuel Shrapnell, Bradford aforesaid Iron Monger and to my cousin John Shrapnell Cloth Drawer and to Doctor Anslowe also of Bradford and to each of them Black Cloth sufficient to make the mourning. Item I give my cousin John Bailward of Bradford aforesaid dark grey Cloth sufficient to make him a suit of Mourning. Item I give and bequeath unto Mary Bishop (now wife of John Bishop of Bradford aforesaid, Scribbler in case she shall survive her said husband the use of their now dwellng house in Bradford aforesaid she keeping the same in repair or of some other house in Bradford equal in value to the same at thc discretion of the Executor herein after named for and during her natural life for her to inhabit in but not to let or otherwise dispose of. Item I give unto the said John Bishop and Mary Bishop and to each of them a suit of mourning suitable to their degree and quality. I give unto John Harris of Bradford Husbandman and Ann his wife and to each of them a suit of Mourning suitable to their degree and quality- I give and bequeath unto the poor of Bradford 40 shillings to be disposed of to them in Bread at the discretion of my executor hereafter named. Item I give and bequeath unto Peter Gibbs of Freshford and to the said John Bailward £20 to be paid them or their survivor of them within 2 years after my decease in and to and for such uses intents and purposes as by any writing under my hands for that purposes attested by 2 or more credible witnesses shall direct and appoint. I give to Elizabeth Wastfield, daughter of William Wastfield a suit of Mouming. Item I give and bequeath unto Thomas Kervill my said Nephew Zachariah Shrapnell and my said cousin John Bailward to be overseers of this my Will desiring that they will be aiding and assisting my executor herein after named in the execution and performance thereof Item all the rest and residue of my estate both Real and personal not hereby Devised given or bequeathed after payment of my debts and legacies I give devise and bequeath to my said Nephew Zachariah Shrapnell to hold to him his heirs, executors administrators and assigns and him I do hereby make and constitute sole and only executor of this my Will.. 17th May 1723.
