Tugwell's Will |
In
the name of God Amen, I Humphrey Tugwell of Bradford in the County of Wilts, Clothier
being in health and of sound mind and memory (praised be to god) do make this
my last wall and testament in manner following: that is to say I give unto William
Lea of Bradford aforesaid Gentleman, my brother Edward Tugwell of Tetbury in the
county of Gloucester, Wool stapler and my brother in law Daniel Jones of Bradford,
Apothecary the sum of £3,200 of lawful money of Great Britain to be paid
within 6 calendar months next after my decease in trust that they and the survivors
or survivor of them and the and the executors or administrators of such surviving
do and shall plan out and retain the same at interest wither on government or
land securities and pay and apply the interest thereof to my wife- Elizabeth Tugwell
for and during the term of her natural life and my will is that the said Interest
monies be paid my said wife exclusive of what she will be entitled unto by virtue
of our marriage agreement and from and a further devise in Trust to pay the said
sum of £3,200 to my sons William Tugwell and Thomas Tugwell share and share
alike provided and my will is and I do hereby direct that to what I have herein
before given for the benefit of my said wife be accepted and taken by her in lieu
and full satisfaction of such dower or kinds as she my said wife may claim or
demand in all and singular my freehold messuages, tenements and heridiaments herein
after mentioned to be given devised unto my son William Tugwell and his heirs
and that my said wife do at the request of my said son William his heirs and assigns
release all her right and title of dower and kinds at.. law of in and to the said
premises and every part thereof and upon refusal thereof I will that the interest
money hereby directed to be paid to her for her life shall be no, longer paid
but shall be paid and applied for the use and benefit of my said son William Tugwell.
I give and bequeath unto my said wife the use of all my plate, linen, household
tools and furniture of what sort or kind so ever for and during the term of her
natural life and from and after her decease I will the same do .. unto the residue
of my personal estate for the benefit of my residuary legatees herein after named
I give and devise unto my son William Tugwell all that Capital Messuage or Tenement
with the appurtenants situate or lying and being in Bradford aforesaid and now
in the occupation of Samuel Cam of Bradford aforesaid Clothier and all workhouses
Wool Lofts Dye House Coach Houses, Barn, Stables, Stone Buildings, Out Houses,
Offices, Gardens, ,Court Yards, Banksides, Conduits, Pipes, Cisterns, ways, Waters,
Advantages and appurtenants to the said messuages or tenement belonging and also
that messuage or tenement with the garden or bankside, appurtenants belonging
situate in Pippett Street in Bradford aforesaid and now in the occupation of William
Bush, Cloth worker and also those several other tenements dwelling houses with
the appurtenants situaute lying and being in Bradford aforesaid and now or late
in the several possessions of John Warman, John Alderwick, Thomas Six, Sarah Tovey,
John Matthews and Sarah Pearce Widow all which Messuages or tenements and premises
herein before given and devised were bought and purchased by me of Paul Methuen
of Corsham Esq, To hold to him my said son William Tugwell his heirs and assigns
forever. I give and devise unto my son Thomas Tugwell All that my freehold Messuage
or Tenement situate and being in Church Street in Bradford and lately bought and
purchased by me of my Brother in Law William Jones to Hold to him my son Thomas
Tugwell his heirs and assigns for ever. I give devise and bequeath unto my said
Son Thomas Tugwell all that my leasehold Tenement situate and being in Church
Street aforesaid and adjoining to the last mentioned Tenement and called "Godbys" with its appurtenants and held under Powlett Wright Esq. To hold to my said son Thomas Tugwell his executors administrators and assigns for and during all the residue and remainder of the term Estate and Interest I have therein subject to the rent and Covenenats in the lease and leases reserved and contained I give devise and bequeath unto my said son Thomas Tugwell all those my leasehold Tenemants and buildings with the lands, gardens and appurtenants belonging situate and being in a certain street called Wolly Street situate and now being held under the Duke of Kingston to Hold to my son Thomas Tugwell his executors Adminns and Assigns for and during all the rest Residue and remainder of the term or terms estate and interest I have therein Subject to the Rent and Covenants in the Lease or Leases reserved and contained I also Give devise and bequeath unto my said son Thomas Tugwell all that my Dyehouse and Land adjoining situate and being in Mill Street in Bradford and which I hold by Lease under the said Duke of Kingston To hold to him my said son Thomas Tugwell his Exors, Admins and Assigns for and during all the term etate and Interest I have therein subject to to Rent and Covenants in the said Lease thereof granted I also give to my said Son Thomas the Dye Furnaces and Utensils belonging to the said Dyehouse herein I give and bequeath unto the said William Lea, Edward Tugwell and Daniel Jones The Sum of £1,700 of lawful money .of Great Britain to be paid within six calendar months.next after my Decease. In trust that they and the Survivor of them and he Exors or Admins of such survivor do and shall place the same out of Interest either on covenant or Land Securities and pay the same for the... or other benefit and advantage of my said son Thomas Tugwell in such manner as my said Trustees shall think fit until he shall attain the age of twenty one years and at such his age I will that the said sum of £1,700 and what Interest may be then due for the same do go and be paid unto my said Son Thomas Tugwell but if my said son Thomas Tugwell shall happen to depart this life before such age then I will and direct that the said Sum of £l,70and what interest may be then duee for the same to go and be paid to my son William Tugwell, His exors or admins I give and bequeath unto my servant Thomas Hazle the sum of £10 to be paid within two calendar months after my decease in case he works with me at the time of my death and not otherwise I also give and bequeath unto my trustees they acting in the trust here by reposed in them the sum of £10 a piece all the rest and residue of my goods chattels rights credits and personal estate whatever/ my funeral expenses debts and legatives being first paid and discharged I give and bequeath unto my said two sons share and share alike and I do hereby make and constitute my said sons - William Tugwell and Thomas Tugwell Exors of this my will revoking all former wills provided and my will is and I hereby direct that my said Trustees deduct and retain out of the said trust moneys and estates all their and eachand every of their temporary costs and expenses relating to the said trust and that they shall not be answerable one for the other or for the costs, receipts or defaults of the other or others of them but each for his own act receipts defaults or for any more of the said Trust and that they shall respectively service or for the loss of any part thereof happening without their wilful default in witness whereof I have hereunto set my hand and seal the 13 October, 1764 Humphrey Tugwell- Signed sealed published and released by the said Humphrey Tugwell the Testator as and for his last Will and Testament in the presence of us and attested in his presence by us William Palmer, Thomas Rogers, Daniel Clutterbuck/ I Humphrey Tugwell of Bradford in the county of Wilts, Clothier do make and publish this to be a codical of my last Will and Testaments dated 13 th October, 1764 and do order and direct that it shall be taken and considered in every respect as part therof and to all intents and purposes the same as if it was inserted in my said Will that is to say who was .. the making of my said Will I have bought and purchased a Copyhold Messuage or Mansion House now in my own Occupation two messuages or tenements thereto adjoining the one now in the occupation of William Jotham and the other late of.. Cripps but now untenanted of and from Paul Methuen Esquire all situate in the town of Bradford a Messuage or tenement in Church Street in the same town now in the occupation of George Edwards of and from Mr. Daniel Jones and others certain fields of meadow and pasture ground lying and being in the said parish of Bradford .of and from the right honourable Lord Radnor and Powlett W right Esquire now I hereby give devise and bequeath the said/Capital Messuage or Mansion House with the outhouses, Gardens, buildings, appurtenances thereto also belonging the said messuages or tenements thereunto adjoining the one aforesaid in the occupation of William Jotham and the other untenanted with the outhouses, gardens, buildings and appurtenances thereunto also belonging the said messuage or tenement in the occupation of George Edwards situate in Church Street with the outhouses gardens and buildings thereto also belonging all the said fields of meadows and pasture situate lying and being in the said parish of Bradford unto my wife Elizabeth Tugwell to hold to her for and during the term of her natural life and after her decease I give and devise the same capital messuage or Mansion house messuages or tenements fields lands and premises and every part and parcel therof with the appurtenances unto George Hayward Tugwell, Thomas Tugwell, Elizabeth Tugwell and Mawby Tugwell, the four children of my late son -William Tugwell to hold them their heirs and assigns for ever on their attainment of their respective age or ages of 21 years as tenants in common and not as joint tenants but in case either should die before they attain the age of 21 years then I give and devise the share of his or her so dying of and in the said premises unto the survivors or survivor of them my said Grand children equally if more than one as tenants in common and not as joint tenants and if but one such survivor to such only one his or her heirs and assigns for ever and if all my said Grand children the said George Hayward Tugwell, Thomas Tugwell, Betty Tugwell and Mawby Tugwell shall happen to die before they attain his her or their age or ages of 21 years or without leaving issue of his her or theirs body or bodies lawfully begotten their I give and devise the said Capital Messuage or Mansion House messuages or tenements fields lands and premises unto my own right heirs forever in witness thereof I have to this my codicil contained in two sheets of paper to the first sheet set my hand and to this second and last sheet my hand and seal 26april, 1775-Humphrey Tugwell signed sealed published and declared by the said Humphrey Tugwell as a codicil to his last will and testament in the presence by us Dan Clutterbuck, William Jotham, James Bulgin. On the 19th September, 1775 Humphrey Tugwell late of Bradford in the County of Wilts deceased was granted to Elizabeth Tugwell, Widow of the Relict of the said Deceased she having been first sworn by commission only to administer Wiliam Tugwell and Thomas Tugwell the sons of the said deceased |
